Terms and Conditions – Spotlights Shopping

1. Identity of the trader

2. Applicability

These terms apply to every offer and purchase agreement through our online store. Customers can read, save and print them before ordering. Mandatory consumer rights prevail over conflicting terms.

3. Offers and product information

We aim to present products, images, colours, specifications and prices accurately. Appearance may vary by screen. Obvious errors, including clear technical pricing mistakes recognisable to a reasonable customer, do not bind us.

4. Formation of agreements

An agreement is concluded after an order is placed and confirmed, unless lawful grounds prevent fulfilment. We send electronic confirmation. We may cancel orders due to unavailability, obvious errors, failed payments or reasonable suspicion of fraud. Payments for cancelled orders are refunded.

5. Prices and payment

Consumer prices are in euros and include VAT unless expressly stated otherwise. Any extra charges are displayed before checkout. Payment methods are shown at checkout. Customers must provide accurate billing and contact information.

6. Delivery

Orders are delivered to the specified address. Delivery times shown on product pages, at checkout or in our shipping policy are estimates unless a fixed date is agreed. We endeavour to meet them and inform customers about delays or non-fulfilment. Statutory delivery rights remain unaffected.

7. Risk in transit

We remain responsible for loss or damage until the customer or their designated recipient receives the goods. Different rules may apply if a customer independently selects a carrier we did not offer.

8. Withdrawal and returns

For most online purchases, consumers have a statutory 14-day cooling-off period starting the day after receipt, subject to legal exceptions. We voluntarily offer 30 days after receipt under our returns and refunds policy, without limiting statutory rights. Contact info@spotlightsshopping.com. 9. Refunds

Valid statutory withdrawals are refunded within the legal period. Where permitted, we may wait for the returned goods or proof of return, whichever comes first. Additional terms may apply to the voluntary 30-day period without restricting statutory rights.

10. Withdrawal exceptions

Exclusions apply only where permitted by law, for example customised or clearly personalised goods, certain unsealed hygiene or health goods, or products inseparably mixed with other items after delivery. Applicable exceptions are disclosed before purchase.

11. Statutory guarantee and conformity

All consumer goods are subject to statutory conformity rights. Products must meet reasonable expectations based on their nature, price, description and our promises. The Netherlands has no single general fixed statutory warranty period; the reasonable expected lifespan depends on the product and circumstances. Remedies may include free repair, replacement, price reduction or termination where legally appropriate. Commercial warranties do not limit statutory rights.

12. Complaints

Send complaints to info@spotlightsshopping.com, preferably with your order number, a description and relevant photos. We handle complaints promptly and aim to respond substantively within a reasonable period. Statutory rights remain applicable.

13. Product use and safety

Use products according to instructions and their intended purpose. Customers should use products carefully. This does not limit our legal responsibility for unsafe or defective products.

14. Intellectual property

Website texts, designs, logos, images and other materials may be protected by rights belonging to us, suppliers, licensors or others. Protected content may not be copied, published, distributed or commercially used without permission unless permitted by law. Third-party brands remain their owners' property.

15. Third-party services and Shopify

Our store uses Shopify and may use third parties for payments, shipping, reviews and other features. Purchase agreements are with JB Partsline B.V., trading as Spotlights Shopping, not Shopify. See our privacy policy for personal data processing.

16. Liability

We are liable as required by applicable law. These terms do not exclude liability where exclusion is prohibited. To the extent permitted by law, we are not liable for damage solely caused by improper use or failure to follow instructions.

17. Force majeure

If circumstances beyond our reasonable control temporarily prevent performance, we inform customers as soon as possible. Examples may include serious carrier disruptions, natural disasters, war, government measures or major technical outages. Mandatory consumer rights remain unaffected.

18. Privacy

We process personal data according to our privacy policy and applicable data protection law. The policy covers cookies and possible data sharing.

19. Amendments

We may change these terms in response to legal or service changes. Generally, the terms in force when the agreement was concluded apply, unless law requires otherwise or another arrangement is agreed. The current version is available on our website.

20. Governing law and disputes

Dutch law applies to consumer agreements, without prejudice to mandatory protections under applicable law. We first seek an amicable solution. Unresolved disputes may be referred to the competent court under applicable law.
